Публічно-приватне партнерство у реалізації державної політики у сфері фізичної культури і спорту в україні: перспективи вдосконалення.

Abstract

У статті проведено дослідження особливостей функціонування механізмів публічно-приватного партнерства у реалізації державної політики у сфері фізичної культури і спорту в Україні у сучасних умовах державотворення. Показано вплив факторів євроінтеграційної політики на формування основних складових елементів даної державної політики. Методологія дослідження базується на застосуванні системного підходу, який дозволив розглянути державно-приватне партнерство як складовий елемент системи публічного управління фізичною культурою і спортом у сучасній євроінтеграційній політиці. Водночас застосовано інтеграційний методологічний підхід, який надав можливість дослідити стадії життєвого циклу державно-приватного партнерства на прикладі використання контрактів повного життєвого циклу. Структурно-функціональний підхід використано у процесі дослідження закономірностей взаємозалежностей між стимулюванням приватного сегменту у механізмі реалізації державно-приватного партнерства і конкурентоздатністю української фізичної культури і спорту. Під час дослідження використано приклади ефективних моделей публічно-приватного партнерства у даній галузі у зарубіжних країнах. У статті схарактеризовано основні елементи розвитку механізмів публічно-приватного партнерства у реалізації державної політики у сфері фізичної культури і спорту в Україні, що базується на удосконаленні чинного законодавства щодо консолідації регуляторного впливу Закону України «Про фізичну культуру і спорт» і Закону України «Про державно-приватне партнерство», що спрямоване на посилення спільної відповідальності влади і комерційного сектору. У статті запропоновані інструменти активізації політики публічно-приватного партнерства, зокрема застосування контракту повного життєвого циклу, приватний контроль і розподіл відповідальності партнерів. Запропоновано внесення змін і доповнень у чинне законодавство України, а також інституційні вдосконалення існуючого механізму публічно-приватного партнерства у сфері реалізації державної політики фізичної культури і спорту щодо активізації фінансування галузі та підвищення її конкурентоздатності.

The article studies the features of the functioning of the mechanisms of public-private partnership in the implementation of state policy in the field of physical culture and sports in Ukraine in the current conditions of the creation of the state. The influence of the factors of European integration policy on the formation of the main components of this state policy is shown. The research methodology is based on the application of a systematic approach, which made it possible to consider public-private partnership as an integral element of the system of state management of physical culture and sports in modern European integration policy, at the same time an integration methodological approach was applied, which made it possible to explore the stages of the life cycle of public-private use. Full life cycle contracts, as well as a structural and functional approach used in the process of studying the regular interdependencies between stimulating the private segment in the mechanism for implementing public-private partnerships and the competitiveness of Ukrainian physical culture and sports. The study used examples of effective models of public-private partnerships in this area in foreign countries. The article describes the main elements of the development of public-private partnership mechanisms in the implementation of state policy in the field of physical culture and sports in Ukraine, based on the improvement of the current legislation on the consolidation of the regulatory influence of the Law of Ukraine "On Physical Culture and Sports" and the Law of Ukraine "On Public-Private partnership”, aimed at strengthening the common responsibility of the government and the commercial sector. The article proposes tools for activating the policy of public-private partnership, including the use of a full life cycle contract, private control and distribution of partners' responsibility. It is proposed to introduce amendments and additions to the current legislation of Ukraine, as well as institutional improvements to the existing mechanism of public-private partnership of state policy in the field of physical culture and sports to enhance the financing of the industry and increase its competitiveness.
