Конституційне будівництво в Україні на етапі утвердження комуністичного тоталітарного режиму (1919-1937 рр.)

Abstract

У роботі проаналізовано основні процеси конституційного будівництва в УСРР та УРСР періоду 1919-1937 рр. Зазначено, що український конституційний процес цього періоду відповідав загальним рисам процесам у РРСФР та СРСР. Із втіленням у життя ідеї республіки рад паралельно йшло формування моделі центральних органів державної влади та управління, органів місцевої влади республіки. Зроблено висновок, що загалом конституційний процес у цей період був спрямований на поступове перетворення України із формально незалежного державного утворення на суб’єкта союзної держави.

В работе проанализированы основные процессы конституционного строительства в УССР периода 1919-1937 гг. Указано, что украинский конституционный процесс этого периода отвечал общим чертам процессов в РРСФР и СССР. С воплощением в жизнь идеи республики советов параллельно шло формирование модели центральных органов государственной власти и управления, органов местной власти республики. Сделан вывод, что в целом конституционный процесс в этот период был направлен на постепенное превращение Украины с формально независимого государственного образования на субъект союзного государства.

The paper analyzes the main provisions of the Soviet constitutions of Ukraine during the period of establishment of the communist totalitarian regime of 1919-1937. The main focus of the study is on the analysis of the constitutional regulations of Soviet Ukraine; study of the stages of formation of the system of central bodies of state power and administration, local authorities of the USSR; characteristics of the main provisions of the Constitutions of Soviet Ukraine in 1919, 1929 and 1937. The article analyzes the latest scientific achievements of the subject of the research, and the main sources of the research was the main Soviet constitutional acts of Ukraine of this period. The main provisions of the article prove that the constitutional construction in Ukraine in the period 1919-1937 corresponded to the general features of the constitutional process in the RSFSR and in the Soviet Union. The structure of the central and local authorities also corresponded to the all-Union «standard», and the central provision of the Ukrainian Soviet constitutions was the implementation of the idea of a republic of councils and the building of socialism. From Soviet Ukraine in 1919 to the Constitution of Soviet Ukraine in 1937 was the formation of a model of central bodies of state power and administration, local authorities of the republic. At the initial stage of the Ukrainian Soviet constitutional process, there was no clear division of powers between the highest authorities of the republic. The powers of the All-Ukrainian Central Executive Committee as the highest and later the supreme body of power of the republic extended to the sphere of activity of the Council of People's Commissars. The functions of the legislature in different periods of this stage of the formation of Soviet power in Ukraine were performed by the Congress of Soviets, the All-Ukrainian Central Executive Committee and even the Council of People’s Commissars. In general, the constitutional process during the approval of the totalitarian communist regime was aimed at transforming of Ukraine from a formally independent state entity to a union republic in the Soviet Union with the rights of autonomy.
